These Terms of Service ("Terms") govern your access to and use of the Stuvia website and services (the "Service").
The Service is operated by Stuvia International B.V., a company registered in the Netherlands ("Stuvia", "we", "us", or "our").
By accessing the website or purchasing any products from the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Service.
2. About the Service
Stuvia provides digital educational materials for purchase and personal study use.
All study materials offered on the website are owned or licensed by Stuvia. Stuvia sells these materials directly to customers and does not operate as a marketplace for third-party sellers.
3. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to use the Service.
By using the Service, you represent that you have the legal capacity to enter into a binding contract under applicable laws.
4. Accounts
To purchase or access certain content, you may be required to create an account.
You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Be responsible for all activity under your account
Stuvia reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
5. Purchases and Payments
All purchases made through the Service are final subject to the refund policy below.
Prices may be displayed in Indian Rupees (INR) and include applicable taxes such as Goods and Services Tax (GST) where required under Indian law. Digital educational materials may be subject to 18% GST.
Payments are processed through third-party payment providers. By completing a purchase, you agree to the terms of those payment providers.
Once payment is successfully processed, the purchased digital content will be made available through your account.
6. Digital Delivery
Purchased materials are provided in downloadable digital format.
Once a file has been downloaded, the transaction is considered completed and the product is deemed delivered.
7. License to Use Content
When purchasing content from Stuvia, you receive a limited, non-exclusive, non-transferable license to access and use the content for personal educational purposes only.
You may not:
- Resell or redistribute the content
- Share the files with others
- Upload the content to other websites or platforms
- Use the content for commercial purposes
- Modify and distribute the content
All intellectual property rights remain the property of Stuvia or its licensors.
8. Intellectual Property
All materials available on the Service, including documents, text, graphics, and website content, are protected under the Indian Copyright Act, 1957 and applicable international copyright laws.
Unauthorized copying, distribution, reproduction, or commercial exploitation of the materials is strictly prohibited.
9. Refund Policy
Due to the nature of digital products, refunds are limited.
A refund may be requested if:
- The material has not been downloaded, and
- The refund request is submitted within 14 days of purchase.
If the material has been downloaded, the purchase is considered fulfilled and refunds will generally not be issued.
Refunds may also be granted in cases of technical issues preventing access to purchased content.
Refund requests may be reviewed in accordance with the Consumer Protection Act, 2019.
10. Acceptable Use
You agree not to:
- Copy, scrape, or extract large amounts of website content
- Use automated tools to download materials
- Circumvent security or access restrictions
- Use the Service for unlawful purposes
- Attempt to distribute purchased content publicly
Violation of these rules may result in suspension or termination of your account.
11. Anti-Piracy and Content Protection
Stuvia strictly prohibits the unauthorized distribution or sharing of purchased materials.
Users may not:
- Upload purchased materials to other websites or platforms
- Share files through messaging apps, cloud storage, or file-sharing services
- Sell, distribute, or publicly share Stuvia materials
If Stuvia detects unauthorized distribution of its materials, we reserve the right to:
- Immediately suspend or terminate the user account
- Remove access to purchased materials
- Pursue legal action where appropriate
Unauthorized distribution may constitute infringement under the Indian Copyright Act, 1957 and other applicable laws.
12. Account Suspension and Termination
Stuvia may suspend or permanently terminate accounts that:
- Violate these Terms
- Engage in piracy or unauthorized distribution
- Attempt to bypass security measures
- Use the Service in a fraudulent or abusive manner
In cases of serious violations, access to purchased materials may be revoked without refund.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Stuvia shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Service or purchased materials.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect and process personal data in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 where applicable.
15. Changes to the Terms
Stuvia may update these Terms from time to time. Updated versions will be published on the website with a revised "Last updated" date.
Your continued use of the Service after changes means that you accept the updated Terms.
16. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India.
